Welcome to Cozy Pool Rush. This User Agreement (the “Agreement”) is a binding contract between you and the operators of Cozy Pool Rush. By accessing or using Cozy Pool Rush, you agree to abide by this Agreement, and by participating in the services provided you acknowledge that you have read and understood all terms and conditions set forth herein. If you do not agree with any part of this Agreement, you should not access or use Cozy Pool Rush.
This Agreement sets forth the general terms and conditions of your use of the services provided by Cozy Pool Rush including but not limited to the mobile application, downloadable content, online services, and any associated updates or enhancements. It is important that you review this Agreement carefully as it affects your legal rights and obligations.
By using Cozy Pool Rush, you agree that you are at least the age of majority in your jurisdiction of residence and can form a binding contract with the operators of Cozy Pool Rush. If you are accessing Cozy Pool Rush on behalf of an organization, you represent that you have the authority to bind that organization to this Agreement. Your use of Cozy Pool Rush constitutes acceptance of this Agreement and all policies referenced herein.
Cozy Pool Rush reserves the right to modify, amend, or update this Agreement at any time. Your continued use of Cozy Pool Rush after any such change constitutes your acceptance of the revised Agreement. It is your responsibility to review this Agreement periodically to ensure that you are aware of any changes. If you do not agree to the amended terms, you must discontinue your use of Cozy Pool Rush immediately.
Cozy Pool Rush provides interactive entertainment services including but not limited to gameplay, virtual items, communication with other users, updates, and technical support. The services may include online elements, social features, and third party integrations. You understand and agree that the form and nature of the services may change from time to time without prior notice to you.
In order to access certain features of Cozy Pool Rush, you may be required to register and create an account. You agree to provide accurate and complete information when registering and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify Cozy Pool Rush immediately of any unauthorized use of your account.
Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy which is available at securetrust.html. By using Cozy Pool Rush, you consent to our collection and use of personal information as described in the Privacy Policy. You agree to review the Privacy Policy periodically as it may be updated from time to time.
You agree that you will not use Cozy Pool Rush for any unlawful purpose or in a manner that violates this Agreement or any applicable laws or regulations. You agree not to engage in any conduct that is harmful, abusive, threatening, defamatory, obscene, or otherwise objectionable. You agree not to transmit any content that infringes intellectual property rights, privacy rights, or any other rights of any third party.
You agree that you will not: (a) copy, distribute, or exploit any part of Cozy Pool Rush without express written permission; (b) modify, reverse engineer, decompile, or disassemble any software or technology associated with Cozy Pool Rush; (c) attempt to gain unauthorized access to any portion of Cozy Pool Rush; (d) interfere with the operation of Cozy Pool Rush or any user’s enjoyment of the services; (e) use any automated system, bot, scraper, or other device to access or use Cozy Pool Rush in a manner that sends more requests than a human can reasonably produce in the same period of time.
All content provided through Cozy Pool Rush including but not limited to graphics, text, images, logos, icons, sound recordings, and software is owned or licensed by the operators of Cozy Pool Rush and is protected by copyright, trademark, and other intellectual property laws. You agree that you will not copy, modify, publish, transmit, distribute, perform, or create derivative works from any content obtained from Cozy Pool Rush without express written permission from the rightful owner.
Cozy Pool Rush may offer virtual items for purchase or as rewards through gameplay. Virtual items have no monetary value outside the context of Cozy Pool Rush and cannot be exchanged for real money or transferred outside of the game except where expressly permitted by the operators. You agree that virtual items will remain the property of Cozy Pool Rush and that your purchase or use of virtual items does not grant you ownership rights.
In-app purchases may be available within Cozy Pool Rush. All payments are processed through the platform provider such as App Store or Google Play. You agree to comply with all payment terms and conditions imposed by the platform provider. All fees paid are non-refundable except as required by law or the platform provider’s policies. You acknowledge that the operators of Cozy Pool Rush do not control and are not responsible for the purchase, payment, or refund mechanisms of the platform providers.
You may terminate this Agreement at any time by discontinuing your use of Cozy Pool Rush and deleting the application from your device. The operators of Cozy Pool Rush may suspend or terminate your access to the services at any time and for any reason, including for violation of this Agreement. Upon termination, all rights granted to you under this Agreement will cease, and you must immediately discontinue all use of the services.
Cozy Pool Rush is provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, the operators of Cozy Pool Rush disclaim all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The operators do not guarantee that Cozy Pool Rush will be uninterrupted, error-free, secure, or free of harmful components.
To the maximum extent permitted by applicable law, in no event shall the operators of Cozy Pool Rush be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of Cozy Pool Rush. In no event shall the total liability of the operators of Cozy Pool Rush exceed the amount you have paid to use the services, if any. Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.
You agree to indemnify, defend and hold harmless the operators of Cozy Pool Rush and their respective affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses arising out of or related to your use of Cozy Pool Rush, your violation of this Agreement, or your infringement of any intellectual property or other rights of any person.
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the operators of Cozy Pool Rush are established, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within that jurisdiction for the resolution of any disputes arising out of or related to this Agreement.
Any dispute arising out of or relating to this Agreement or the services provided by Cozy Pool Rush shall be resolved through confidential binding arbitration in accordance with the rules of the applicable arbitration authority. You agree that the arbitration shall be conducted on an individual basis and not as a class action. The arbitrator’s decision shall be final and binding.
